An Indigenous woman who works with people charged with non-violent crimes says many people charged with an offence are not being informed about their rights to have a Gladue report written on their behalf.
A Gladue report is the story of a person’s life and is presented to the court to help a judge seek alternative forms of justice rather than sending the person to jail or prison.
Its name comes from a case that went before the Supreme Court of Canada in 1999.
But nearly 20 years after that ruling, lawyers are still not following the law.
Its a Supreme Court right that needs to be respected and adhered to but I agree most Lawyers are ignoring, waiving etc that right for their clients due to the excuse it will take too long for a Gladue report to be done…that is absolute nonsense…I work in the courts everyday in central alberta and I see it firsthand…we need the Justice system to wake up and acknowledge our right to use the Gladue report…

Wow, well said, It is true, i know people who weren’t offered the Gladue Report along with bail, or bail plans. lawyers don’t help much, unless you have money.
A persons rights have to be explained Properly, we all don’t know Legal Terms and what can happen…..
