BATTLEFORD, Sask. – A defence lawyer says an Indigenous teen who died in a shooting on a Saskatchewan farm was the victim of a freak accident.Gerald Stanley’s lawyer is making his opening arguments before a jury hearing the man’s second-degree murder trial.Scott Spencer told jurors that 22-year-old Colten Boushie’s death wasn’t justified, but they must put themselves in Stanley’s shoes.He said the Stanley family was facing intruders on their farm near Biggar, Sask., in August 2016 which created a panic situation.Spencer suggested it wasn’t unreasonable for warning shots to be fired to scare off the intruders and called the fatal shooting a “freak accident in the course of an unimaginably scary situation.”Boushie was sitting in the driver’s seat of a grey Ford Escape when he was shot.”This is not a justified death. It is never right to take somebody’s life. But that’s not what this case is all about,” Spencer told court in Battleford, Sask., on Monday.”For farm people, your yard is your castle. We have a family. They were working on their ranch. That’s what the day started like for Gerry and his family. What happened is they faced essentially (an) intruder.”Court has heard an SUV with a flat tire carrying five people drove onto the Stanley farm. The driver testified the group had been drinking during the day and tried to break into a truck on a neighbouring farm, but went to the Stanley farm in search of help with the tire.Stanley’s son has testified that on the day of the shooting, he and his father heard an ATV start and thought it was being stolen. The pair ran toward the SUV and threw a hammer at the windshield as the driver tried to leave the farm.Sheldon Stanley said he went into the house to get his truck keys and heard two gunshots. He said he heard a third when he came back out. He told court he saw his father, looking sick, with a gun in his hand saying, “It just went off.””You have to view it from Gerry’s perspective and what he faced. The fear, the unknown. When you’re in a situation where you have intruders and you don’t have the luxury of being able to wait for police assistance. This case comes down to what’s reasonable,” Spencer said.”It’s not a self defence. What can you do to protect yourself in those circumstances? You can’t use lethal force but is it reasonable to deal with the circumstance to protect you and your family?”Spencer suggested Stanley’s gun misfired.”The reality is the gun just went off. If they would have just stopped … stopped stealing … just walked away he wouldn’t have had to go over there.” said Spencer, who added that Stanley will take the stand to explain what happened.The Crown wrapped up its case last week.

Yes he did feel threatened and property was likely going to be stolen. But like it or not, in Canada, we don’t have the right to protect our property or family with deadly force. And that is most certainly what this was. Deliberate intention to pull the trigger of functioning firearm directed at the young natives head.

    Second the Pm and Justice minister have no business commenting on individual cases and outcomes. Policy and procedures only. If the victim had been white most certainly no tweet from the pm for a white victim.

  5. Wow everyone leaving comments are so far off base they obviously haven’t read any of the trial details. He didn’t have three misfires, he fired warning shots – and alleges there was a hang fire in which he pulled the trigger, but the gun did not immediately go off. It would be panic and chaos indeed. Especially after they intentionally rammed his wife’s vehicle.

    Any they weren’t driving on a flat – they were already down to the rim. One look at the vehicle will tell they would have continued driving it right into the ground. Hence trying to steal a truck from the farm before Stanley’s. Oh but right all of the sudden they want help for the vehicle that is missing the front grill, bumper hanging off, muffler dragging on the ground that they tried to “break off”. Seeking help my ass.

    There are so many inconsistencies, likely because they were all so drunk they don’t even remember themselves what happened. The two women testified he was in the backseat, and then passenger side front seat, but he was shot in the LEFT side of the head, which would make that impossible, and the women pulled him out of the drivers side. Also Meechance says that they shattered the windshield and the glass got in his eyes. Really? You can see in the picture of the SUV it is only a spidered crack. The glass remained intact.

    The fact that someone died is a terrible consequence to many stupid actions, and a terrible tragedy. I’m sure the very last thing Gerald wanted to happen on that fateful day. No one should have died, but also they should have not been driving HAMMERED, trying to steal.

    1. For information only: 10 years ago my 3 brothers and myself were having a competition in target practice. It consisted of 5 targets at 25 yds. spaced 3 yards apart. you had to shoot all 5 targets in a 15 second span or the timer would ring and then continue on until the timer reset at one minute .for the next shooter . scoring was based on time and accuracy for each bulls eye distance, from center on all targets..My brother and I had a Browning 22 semi automatic one brother a Mosberg semi and one a remington semi auto 22`s. Completing my turn my twenty 22 browning remained on the sandbag pointing at the target. Note! the rifle was re-chambered with a life round ready to fire again with the pull of the trigger safety off, this is what semi automatics do.We were all behind the 22 scoring my turn with a spotting scope time versus accuracy , no one was near the browning semi automatic. It fired on it`s own and then the timer reset to one minute.We were all shocked , we knew I had got off 5 rounds in the 15 second time before the timer dinged, The hangfire as they call it ,took place almost 40 seconds after, and then the timer rang to reset itself., to one minute. So the accuracy of the time interval could not be disputed.We all filled out affidavits to what occurred. I then shipped my browning semi automatic back to the browning factory for testing and verification. t was returned as verified by the factory.
      The federal ammunition was mine and we all used that ammunition. I know for a fact it was over ten years old on sending the ammunition remaining back to the factory they also experienced a hang fire on the remaining cartridges in the 1000 round box.. The following was their analyses The powder in the shells was old, and moisture entering condensed the remaining powder to a higher density creating an overload or wildcat cartridge. The resulting chambering of this cartridge by the rifle created pressure all around the casing causing extreme pressure on the powder, this together with the moisture condensation created an automatic pressure ignition. resulting in firing of the cartridge.
      Lessons learned : keep your firearm clean.
      Store ammunition in a cool dry environment.
      Dispose of old ammunition after two years and purchase new.
      Remember a bullet is a miniature BOMB.
      Enjoy your hobby but take care.

  6. To me, I often think what it would like to have our own country, I listen to all the vile things white peoples say about us natives. They don’t care about Colten, they are happy to see him Parrish. Why? I’ve been learning that natives are beginning to challenge there white privilege, because there government is opening up to diversity and there white privilege is disappearing in the process. That’s why they hate natives so bad, because we are not only catching up to these people , a lot of our people are surpassing them. This isn’t the 50s anymore, and if Stanley isn’t convicted, then the world will see saskatchewan as a Mississippi in Canada. He needs to be convicted to show this kind of killing and taking justice into your hands vigilante style will not be tolerated. If he isn’t, then it shows how there are still some older generation white people still pulling strings for there fellow white man. Remember people, besides in the United States, the kkk are most populated in this province, and have spread through education, judicial, economic, and all other departments of this conservative government. That’s why farmers are gong hoe on electing conservative representation. They control a lot of stuff in Saskatchewan, read histories of the southern farmers and it spread throughout all of saskatchewan rural areas. How else do u have Andy peekekoot in prison for the rest of his life for not even taking a life, or the 12 year old native girl raped in melfort, and the 2 white boys each served 1 year house arrest and many more jaw dropping sentances that a native would locked up for life for. Don’t get me wrong, there are good white people, many have empathy for natives, but would never stand with us in this stand against racism, inequality, and inhumane treatment cause it would conterdict there loved ones beliefs, and friends beliefs. After which, you would have to also unlock the trigger lock (because according to the gun safety laws, you have to have trigger locks on your firearms). Then run to the ammo safe, after retrieving the ammo box keys, and unlock that (because, according to the gun safety laws, you got to lock up your ammo separately from your gun). Then you got to load the gun (because according to the gun safety laws, you can’t keep firearms loaded). But, somehow, his gun just went off, accidentally….three times!     In which they must display their knowledge and handling safety. One of the biggest lessons is to never point a handgun at someone In case there is a misfire , common sense !! Accidents do happen , panic and rage are not an excuse for taking a life .

  24. The defense is grasping at straws. A freak accident where a gun is pointed at the victim and the gun goes off 3 times? The gun did not misfire. Ballistic tests were done on it. In his anger he killed a young man and is now regretting the consequences. I hope the all white jury sees the truth and convicts this man on second degree murder

I understand the frustration of people coming on your property and the threat you feel as I live on a rural property also but using your weapon should be the absolute last resort. In the end it comes down to their words against the farmer and we know whose words they will believe. Just sad and sickening all around!!

The rumor in the area if the stolen equipment was always blamed on the natives from neighboring reserves, there was an article I read like a week ago or so that said the stolen equipment was found on another famers land because someone suspected he had way too much equipment for a small piece of land (I gotta look for that and post in on this thread ltr) I wonder how long his driveway is because he must of seen them coming down the road with that tire looking for assistance, otherwise why would he have the time to get his gun and load it and go outside to start shooting, then again it was already loaded and ready to fire, there was no mention anywhere of an attempt to steal an atv until now in his defense, looks like he’s coming out with a whole bunch of things to show himself as the victim in defence. He was prepared to shoot a native when one came onto his land and then it happened. Who shoots directly at the driver side of the vehicle and keeps shooting?

      1. Jurors are picked based on wherther or not they present a bias in advance of evidence. Wearing t-shirts that say justice for Colten is fine but it’ll get you disqualified on the ground if prejudice without evidence. Whether this was right or wrong, people who’ve been charged have the right to be judged on facts and not feelings.

    2. Each side can reject “challenge” up to 12 juriors when going through selection with no explaination. So if the defence challanges each non white juror who comes up there is nothing the crown can do. Only way to get non white ones is for the defence to use up all 12 challenges and then hope the jury isn’t yet filled and some non white ones are chosen at random.

    2. I have been following this case since inception. Does anyone know where I can read the trial transcripts.
      I have followed close to 100 cases and from what I have concluded so far is from the get go the whole investigation has been the sloppiest I have ever seen.
      The obvious is the poor preservation of the crime scene just for starters. I could write a book along on just the ridiculous and inconsistencies from the defense. I have read the trial transcripts yet.

      However just some food for thought. I know for example they had 40+ mm of rain before the crime scene was thou roughly processed.

      1) if Stanley reached in with his left hand to try to get the keys, why don’t we see scuff marks on the muddy door??

      2) why is there no blood on the ground where the 22 was located, but plenty on the bolt action area.

      3) was there forensics on the farmers pants compared to the dust from the door to collaborate his story

      4) how easy would it be two place a dud casing on the dash from a round that may have been used at another time with the actual casing

      5) hang fire , that’s grasping at straws

      There are way more inconsistencies I see, just on the evidence alone.

    1. Agree….what a lame excuse for defense…why would he grab a handgun in the first place…and then one shot would be freak accident – but times three (3)…there certainly must be gun powder residue on the victim’s head of Colton…..Gerald Stanley is clamoring for a logical excuse but to no avail…

    2. exactly…Spencer suggested it wasn’t unreasonable for warning shots to be fired to scare off the intruders and called the fatal shooting a “freak accident in the course of an unimaginably scary situation.” — yea because aiming the gun RIGHT AT someone is going to be a warning shot. Also, in the article they postulate that his gun misfired….again…aiming RIGHT AT someone with a gun is an excellent way to not shoot at them.

    3. Yeah, there’s no way that gun was fired by accident. And if it was, then he sure as hell shouldn’t be allowed to be a gun owner, what with all the accidentally killing people and all.

    In North Battleford! Just realized what that really means as I’d no historical facts on the massacre or racist violence there, though I’ve studied Canada’s colonial history in University . I am sickened and enraged by this entire shit show. No hope of justice.

      1. Jurors are picked based on wherther or not they present a bias in advance of evidence. Wearing t-shirts that say justice for Colten is fine but it’ll get you disqualified on the ground if prejudice without evidence. Whether this was right or wrong, people who’ve been charged have the right to be judged on facts and not feelings.

    1. Each side can reject “challenge” up to 12 juriors when going through selection with no explaination. So if the defence challanges each non white juror who comes up there is nothing the crown can do. Only way to get non white ones is for the defence to use up all 12 challenges and then hope the jury isn’t yet filled and some non white ones are chosen at random.

  40. Nothing of value will justified the life of any person who died as a accidental gun going off. A kid has died over something that can be replaced.. this kid has family n friends who loved him and now will never see him.

    1. The terror of what occured on this family and the events the transpired because of a drunken joy ride… plus the response from this community shared..ive lost trust… opptunistic…

    2. I have been following this case since inception. Does anyone know where I can read the trial transcripts.
      I have followed close to 100 cases and from what I have concluded so far is from the get go the whole investigation has been the sloppiest I have ever seen.
      The obvious is the poor preservation of the crime scene just for starters. I could write a book along on just the ridiculous and inconsistencies from the defense. I have read the trial transcripts yet.

      However just some food for thought. I know for example they had 40+ mm of rain before the crime scene was thou roughly processed.

      1) if Stanley reached in with his left hand to try to get the keys, why don’t we see scuff marks on the muddy door??

      2) why is there no blood on the ground where the 22 was located, but plenty on the bolt action area.

      3) was there forensics on the farmers pants compared to the dust from the door to collaborate his story

      4) how easy would it be two place a dud casing on the dash from a round that may have been used at another time with the actual casing

      5) hang fire , that’s grasping at straws

      There are way more inconsistencies I see, just on the evidence alone.
